Terms and conditions

Preamble: The following provisions establish the general conditions of sale of products offered by the Hipanema Company on its website at the following address: www.hipanema.com. Hipanema is a limited liability company with a capital of 1000 € whose registered office is located at 9/11 Rue Albert Einstein 93000 Bobigny and is registered at the Registre du Commerce et des Sociétés de Paris under the Siret number 750 123 291 00015 and VAT: FR52750123291. By accepting the Terms and Conditions, and by clicking on “Confirm your order”, the client definitely confirms his order.

The Hipanema Company makes it impossible to sell products without having accepted the provisions below.

ARTICLE 1

PURPOSE: The present conditions aim to define the terms of sale between Hipanema and the client, from the order to the services, passing through the payment and the delivery. They regulate all of the steps necessary for placing orders and ensure the tracking of the order between the contracting parties.

ARTICLE 2

PRODUCTS: Hipanema aims to offer for sale its own jewelry and other products and fashion accessories in the limit of the stock available. The products are those listed for sale on the day of consultation by the user. When the product is unavailable, it will appear on the website, otherwise, in case of an error, Hipanema undertakes to inform the customer by email in the shortest possible time. If the product has already been paid for, Hipanema undertakes to refund the price of the item to the client. The products offered for sale are described and presented with the greatest possible accuracy. However, if errors or omissions may have occurred in this presentation, Hipanema’s responsibility cannot be engaged. The photographs and texts illustrating the products do not enter in the contractual field.

ARTICLE 3

PRODUCT PRICES: Prices are in Euros including tax. They take into account the French V.A.T., applicable on the day of the order. If the V.A.T. rate was to change, these changes would be reflected on the price of the articles. Hipanema reserves the right to modify its prices at any time. However, the prices may not be changed once the order is confirmed. Prices do not include shipping costs, which will be added to the total order cost and will be specified to the customer upon validation of his/her order.
The products remain the property of Hipanema until full payment.

ARTICLE 4

ORDER:

-REGISTRATION OF AN ORDER: The customer who places an order directly on the website www.hipanema.com will have to follow the following procedure: the customer will select the different products for which he/she has interest in and will successively click on the “Add to Cart” link. The customer will have the opportunity at any moment to either get a summary of the selected products by clicking on the link “My Cart”, or to continue with its purchases. The customer will finalize the order by clicking on “Payment”.


The order can only be registered on the website if the customer is clearly identified on the website by entering their email address and password, which are strictly personal. Once identified, the user will receive an order confirmation by email summarizing: the nature, quantity and price of the products selected by the user, as well as the payment method, contact details and address of delivery of the package. Any order implies acceptance of prices and description of products available for sale.
 Shipping costs are calculated according to the country of delivery.

- ORDER CONFIRMATION: The order is effective once the client has read and approved the terms and conditions by clicking on the box “CONFIRM” made for this purpose. Payments are made by PayPal or by credit card. Hipanema will acknowledge receipt of the order upon validation by email.

ARTICLE 5

PAYMENT AND SECURITY OF TRANSACTIONS: The amount due by the customer is the amount indicated in the order confirmation. To ensure the security of payments, the Hipanema.com website uses the secured payment services of PayPal and Sogenactif (Société Générale). Payment will be made on the www.hipanema.com website via PayPal or by credit card (Visa, Master Card/Eurocard). In any event, Hipanema reserves the right to refuse any order or delivery in case of an existing dispute with the customer, namely total or partial non-payment of an order, a refused credit card payment or for any other reason which Hipanema reserves the right to explain to his client. Hipanema’s responsibility will not be liable in this respect in any case.

Once the order is confirmed, the payment request is routed in real time on the secure electronic payment handler. The secure electronic payment handler will issue an electronic certificate.

ARTICLE 6

WARRANTIES:

REFUND
All products can be subject to a refund.
If you change your mind you have according to the law (Article L.121-21 the Consumer Code) a period of retraction of 14 (fourteen) days after receipt of your order to return your purchases against their refund. To do this, simply follow the steps in the MY ACCOUNT/MY ORDERS section on www.hipanema.com:

               
1. Select the items you wish to return
2. Choose the type of return “REFUNDS” and confirm.
3. Print the return slip which you will receive by email.
4. Post your tracking letter in a mailbox or your Colissimo at a La Poste office.

 

Return costs are at the customer’s charge. We recommend using a tracking letter of 150g to return up to 2 Hipanema Bracelets (1 bracelet weighs 60g) or a tracking letter of 300g to return up to 5 bracelets. For Wild item returns, we recommend using a Colissimo envelope.

Your articles must be returned in their original packaging and in their original condition, accompanied by the delivery note received by email at the following address:

We do not do standard exchanges. For a new size, another model, or a different color, simply make a new order on our E-Shop. Shipping costs are free of charge for France.

 

Upon receipt of return, you will be refunded on the bank account used for payment within a maximum period of 10 days after receipt of your package in our offices.

 

AFTER SALES SERVICE

 

If a model is defective and needs repair, all models are warranted for 30 days.

For orders made on www.hipanema.com, the warranty begins on the date of receipt of the order.

In order to benefit from this warranty, simply follow the steps in your online account section MY ACCOUNT / MY ORDERS:

 

  1.        Select the items you wish to return.
  2.        Choose the type of return “GUARANTEE” and confirm.
  3.        Print the return slip which you will receive by email.
  4.        Post your tracking letter in a mailbox or your Colissimo at a La Poste office.

 

Defective products will be taken care of at the Hipanema office located at 29 rue Bernard Bobigny, France.

Repairs take up to two weeks, excluding shipping time.

Customers who have bought an Hipanema or Amenapih product in a physical store or on an online retailer shop (GaleriesLafayette.com, Brandalley.fr…) must contact the retailer where the purchase was made.

Only the purchase invoice (or sales receipt with a legible date) is a valid proof of warranty.

 

If the warranty period has expired, repairs are available to customers at the following charges:

 

Complete change of clasp: 15€

Change of clasp on one side: 8€

Simple repair such as missing beads and faulty bracelets: 8€

The return of out of warranty products must be accompanied with the payment (by check to the order of Hipanema). For logistical reasons, from now on international returns (countries outside the EU) are no longer accepted. Thank you for your understanding.


Every bracelet under warranty will be repaired or replaced free of charge, if the client completes the necessary steps in their customer area.
However, if the client makes his own repair and the bracelet is damaged, the customer will have to pay to repair costs.

LOSS OR THEFT: an order delivered but not received will be reimbursed if the loss/theft is reported by the customer within a 1 (one) month period maximum after the order.


ARTICLE 7

INTELLECTUAL PROPERTY: All elements of the Hipanema website such as the products, visuals, including the underlying technology covered by intellectual property rights are protected and are the exclusive property of Hipanema. Any fraudulent use will be prosecuted. A user who has a personal internet website and wishes to place, for personal use, on his/her website a simple link to the Hipanema website, must request permission from Hipanema. On the other hand, any hypertext link to the Hipanema website and any use of the framing technique, deep linking, in-line linking or any other deep link technique is prohibited. In any case, any link, even tacitly authorized, must be removed at the request of Hipanema. Hyperlinks can be sent to other sites than www.hipanema.com. Hipanema disclaims all liability if the content of these sites violate the laws and regulations.

ARTICLE 8

DATA PROTECTION: For the purposes of its business, Hipanema reserves the right to collect personal data concerning website users, including through “cookies”. The consumer acknowledges being aware of this. To this end, the processing of information, including the management of user email addresses, was the subject of a declaration to the CNIL. In all cases, and in accordance with the law of January 6 1978, the consumer also has a right of access and correction with respect to any information which concerns him on the files contained in the HIPANEMA Company. Any customer of the website may at any time oppose to the commercial use of the said data and further benefits from a right of access, correction and deletion of data concerning them, directly on the Internet via the contact section of the website.

ARTICLE 9

SIGNATURE AND PROOF: In all cases, the online provision of the credit card number and the final validation of the order will be worth proof of the entirety of the said order under the provisions of Law No.2000-230 of March 13 2000 and will be worth the sums due incurred by the seizure of the times listed on the order form. This validation is worth signature and express acceptance of all operations on the website. However, in the case of fraudulent use of his/her credit card, the customer is required, upon the finding of such use, to contact the Hipanema customer service by sending an email to shop@hipanema.com. The records stored in the HIPANEMA Company’s computer systems and its partners under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties. In all cases, all orders paid by credit card and validated are worth signature and acceptance of all operations on the website.


ARTICLE 10

CUSTOMS DUTIES: Any order placed on the www.hipanema.com website and delivered outside of the French territory, may be subject to taxes and customs duties levied when the package reaches its destination. These customs duties and possible taxes related to the delivery of an item are at the customer’s expense and under its responsibility. Hipanema is not required to check and inform customers of customs duties and any applicable taxes. In order to know them, it is up to the customer to check with the relevant authorities of the country of delivery.


ARTICLE 11

ENTIRE AGREEMENT: These terms and conditions of sale and customer order summary form a contract and constitute the entirety of the contractual relations between the parties.

ARTICLE 12

DELIVERY: The products are shipped with the supporting invoice, to the delivery address provided by the customer when ordering. Every order validated before 9am is processed the same day.


The delivery times indicated are, nevertheless, target dates starting from the day following the validation by the customer of the order, and correspond to the processing time and product delivery. In no event shall the specified delivery time be enforceable or incur liability from Hipanema. In case of unusual delay, however, an email may be sent to the customer by Hipanema.
Hipanema declines any responsibility in case of a delayed delivery or too important due to eventual problems with the postal services or means of transport, in case of loss or theft of products ordered, strike, or any fortuitous events of force majeure.
Transport risks are borne by the customer, who must make a reasoned protest with the postal services or with the carrier within three working days from the delayed delivery shipped by Hipanema.

Despite the care taken by Hipanema in preparing the packages, it is possible for a product to be missing after transport of the package. Therefore, upon receipt of the order, the customer will verify the products received.
Any anomaly concerning the delivery must always be notified within 3 days of receipt of the order to the Hipanema customer service by writing to sav@hipanema.com, or by registered mail with acknowledgement of receipt at 1 rue de Metz 75010 Paris.

If delivery of an opened and/or damaged parcel (cardboard with visible opening marks and/or damage) the customer is imperatively required to refuse it. Indeed, packages leaving the Hipanema warehouses are always spotless, and must be delivered in such state. If a damaged parcel was deposited in your mailbox or approved by your gatekeeper, the package is considered “accepted as is”. If no reservations has been issued within 3 working days of receipt of the order to the Hipanema customer service by writing to sav@hipanema.com or by registered mail with acknowledgement of receipt at 1 rue de Metz 75010 Paris, Hipanema will not be able to take into account the possible disappearances, or make any compensation.

Any claim made after this time will be rejected and Hipanema will be exempted from liability. If the above conditions are met.


DELIVERY TIMES AND RATES: The times indicated are indicative delivery times of our carriers in working days. All prices are in euros including tax. Parcels are delivered by the post office in 2-8 business days (for France). They are delivered to the delivery address indicated on your order form.

If absent, the postman leaves a notice, stating the conditions for withdrawal of your Colissimo (place and time). You can track your parcel on the www.coliposte.net website.

To get your tracking number in case of non-receipt of the automatic email, please send an email to shop@hipanema.com stating your name and order number.
In case of non-receipt of the parcel after 10 days, it is recommended to check the situation on the coliposte.net website and to contact Hipanema by email at shop@hipanema.com.

 

ARTICLE 13

DISPUTES/APPLICABLE LAW

The language of these general conditions of sale is French. This contract is subject to the French Law. And in case of litigation related to an order and/or to these terms of sale, the French courts will have jurisdiction.
